Force of Law

Yesterday was a good day. But you don’t want to hear about nerd rants.

I took my wife to the hospital for minor surgery. It was successful, and the patent lived.

There are hardly any places in this state that are “gun free zones”. Post offices, courts, and jails are the limit, as far as I know.

While schools are “gun free zones”, the law says that if you have a permit to carry, you can carry in school zones.

Certain parts of court buildings are gun free zones. When I went to support a friend, I was in the court building, carrying. There was a metal detector between me and the courtroom, which was a true gun free zone.

Post offices were made “gun free zones” when a postal worker went bonkers and killed some of his coworkers. Under leftist logic, that means that The People need to be disarmed when entering postal property.

Postal property including the parking lot.

This is being challenged in court.

If you look at the image, you will notice that there are no references to any legal documents.

For example, the signage in Massachusetts has “G.L.C. 266 § 120” on it. New York’s signage says it is a felony and “Penal Law § 265.01-D, Penal Law § 265.01-E”. Texas signage says, “Pursuant to section 30.05, penal code (criminal trespass), a person may not enter this property with a firearm”.

The sign on the hospital? No such verbiage. That is because it does not have the force of law behind it.

In my state, a NO GUNS sign doesn’t mean anything.

If the owner of the property discovers I’m carrying, they can have me trespassed. That’s it. It isn’t the sign, it is just their right as a private property owner.

They can trespass anybody they want for any reason.

It is nice to live in a free state.

In Texas it’s 30.06 for concealed carry prohibited, and 30.07 for open carry. I’ll have to look up what 30.05 is…
    Ahhh… 30.05 is unlicensed carry.

as far as private property here in Maine its the same- they ask you to leave or trespass. BUT, here if you have a permit the popo can revoke your permit and confiscate your firearm…. sign must be prominent and on every entrance.. not too many businesses are posted here. the ones that are I won’t go in.. its a dumb “law” and as we have seen completely ineffective in preventing problems… as I like to point out to dummies- murder is a felony, gun free zone is gonna change some phycos mind..

The “30.05” sign comes from the newly enacted Firearm Carry Act of 2021. Tex. Penal Code § 30.05(c) gives property owners a new option. This sign provides notice to exclude only those carrying without a Texas License to Carry (“LTC”) or other recognized license or permit in places governed by the general trespass statute.
30.06 and 30.07 signs only apply to LTC holders. In short, a Tex. Penal Code § 30.06 sign that meets all legal requirements prohibits the concealed carry of a handgun by a license holder in or on the premises. A Tex. Penal Code § 30.07 sign that meets all legal requirements prohibits the open carry of a handgun by a license holder in or on the premises. If both signs are posted, it means that both open and concealed carry of a handgun by a license holder is NOT authorized.

Texas has constitutional carry, but having a Texas LTC has some perks – https://www.dps.texas.gov/section/handgun-licensing/ltc-benefits
Carry on a Premises – get a do-over in some cases of trespass
Handgun Purchasing – alternative to Fed background check
Personal Identification- Personal Identification: The license must be accepted by most businesses as a valid form of personal identification. & Voter ID:

New York’s posting regulation has been modified by a ruling out of the Federal Western District that basically makes Carry on private property accessible to the public legal.

NY gun owners are looking to have it legal in all of Upstate NY (it practically is now, thanks to Federal courts).
