Judge Immergut is the same federal judge who found that Oregon’s Measure 114 is Constitutional.

Measure 114, of course, is a 2022 ballot initiative which, among other things:
– Bans “high-capacity magazines” (e.g. more than 10 rounds);
– “Closes the ‘Charleston loophole'” by ending “default proceeds” (a “default proceed” is one in which, if the background check isn’t clearly Denied after three business days, the dealer may transfer the firearm) — the measure requires a clear Approved response, so the State Police could theoretically kill the firearms industry just by taking forever to run the “instant” checks; and
– Requires a permit-to-purchase for any firearm — to be renewed every five years — which requires a criminal background check (already required for all firearm transfers) and classroom and live-fire training by law-enforcement-certified instructors to qualify for a permit-to-purchase — however, the measure does NOT provide funding for law enforcement to review or certify instructors or their curricula, does NOT specify any requirements or qualifications for those instructors or curricula, and does NOT provide funding for the permitting schemes OR require that the agencies even accept applications, let alone issue the permits; and
– Requires law enforcement to maintain a database of every person who applies for or receives a permit-to-purchase, and publish it among other law enforcement agencies annually.
